Asset tokenization of real estate assets is very much alike to taking a private business public. An investor can acquire tokens of a property and become an owner of the tokenized property in the proportion of tokens acquired from all the tokens available. By acquiring these tokens, the investor will have a right to the property’s profits, which will then be distributed to all token owners on a pro-rata basis. For instance, if you own 1% of a tokenized property, you will receive 1% of the property’s profits on a periodic basis.

In its purest definition, an asset is a valuable resource owned by someone or something which represents a good (e.g., land, patent) or contractual agreement (e.g., financial instruments, such as cash, stocks, equity, bonds or derivatives), and which can be used as means of exchange or investment.

Assets can be traded on secondary markets.

How will assets be traded in secondary markets? To ensure the trading of security tokens only on regulated marketplaces, a set of regulations is needed.   • Cheltuieli aferente achiziționării de aplicații informatice specifice pentru persoanele cu dizabilități;
  • Cheltuieli aferente achiziționării soluțiilor IT pentru comerțul electronic;

Veniturile realizate de persoanele fizice din transferul de monedă virtuală reprezintă venituri impozabile și le sunt aplicabile prevederile Cap. X „Venituri din alte surse” din Titlul IV – ”Impozitul pe venit” din Codul fiscal1.

Veniturile impozabile cuprind atât veniturile în numerar (care presupun o remuneraţie financiară), cât și cele în natură (spre ex. produse, servicii, călătorii etc.)2.

Declararea veniturilor

Persoanele care realizează venituri din transferul de monedă virtuală au obligaţia de a declara aceste venituri prin completarea și depunerea Declarației unice privind impozitul pe venit și contribuțiile sociale datorate de persoanele fizice – Capitolul I. Date privind veniturile realizate la organul fiscal competent, pentru fiecare an fiscal, până la data de 25 mai, inclusiv, a anului următor celui de realizare a venitului3.

Calculul impozitului

Impozitul pe venit datorat pentru aceste venituri se calculează de către contribuabil prin aplicarea cotei de 10% asupra câștigului realizat, determinat ca diferenţă pozitivă între preţul de vânzare și preţul de achiziţie, inclusiv costurile directe aferente tranzacţiei.

Câștigul sub nivelul a 200 lei/tranzacţie nu se impozitează, cu condiţia ca totalul câștigurilor într-un an fiscal să nu depășească nivelul de 600 lei4.

Termenul de plată a impozitului pe venit este termenul limită de depunere a Declarației unice privind impozitul pe venit și contribuțiile sociale datorate de persoanele fizice – Capitolul I. Date privind veniturile realizate.
